GenieTools – Terms of Service - Holistic Data Solutions

These Terms of Service («Terms») govern the use of applications developed by Holistic Data Solutions, S.L., a company registered in Spain with its registered office at Carrer de Balmes, 245, 247, Piso 3, Puerta 3 y 4, Sarrià-Sant Gervasi, 08006 Barcelona («Holistic», «we», «our», or «us»).

Our apps are made available exclusively through the Monday.com Marketplace. We are not owned by, operated by, or affiliated with Monday.com Ltd. By installing or using any of our applications (the «Apps»), you («you» or «User») agree to be bound by these Terms. If you do not agree to these Terms, do not use our Apps.

This policy applies exclusively to the Apps developed by Holistic Data Solutions, S.L. and does not cover our corporate website or any other services.

1. Eligibility and Acceptance

By installing and using our Apps, you confirm that you are at least 16 years old and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.

2. Scope of the Services

Our Apps are software tools that integrate with the Monday.com platform and are accessible exclusively through Monday.com. They are designed to enhance productivity and workflow within Monday.com, and they function in accordance with its API and user interface.

3. License and Permitted Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Apps strictly for internal business operations within the Monday.com platform.
You agree not to:

Modify, reverse engineer, or decompile any part of our Apps;
Use the Apps outside of Monday.com;
Use the Apps in any unlawful manner or to store or transmit malicious code.

4. Support and Maintenance

Holistic may provide support for bug fixes or improvements at its sole discretion. Users may contact our support team via mondaydev@holisticds.com.

5. Modifications and Discontinuation

We reserve the right to modify, suspend, or discontinue any feature of the Apps at any time without liability. We will provide notice via Monday.com or email in case of material changes.

6. Customer Data

You retain ownership of any data you input into the Apps via Monday.com. We do not store your data on our servers; all processing and storage are handled within Monday.com’s infrastructure. We do not access, copy, share, or use your data for any purpose beyond what is necessary to provide the App functionality.

7. Termination

You may stop using the Apps at any time by uninstalling them from Monday.com. We may terminate your access if you violate these Terms. Upon termination, any data related to your use will be removed in accordance with Monday.com’s data retention policies.

8. Disclaimer of Warranties

The Apps are provided “as is” and “as available”. We make no warranties, express or implied, regarding the availability, reliability, or performance of the Apps.

9. Limitation of Liability

To the maximum extent permitted by law, Holistic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data or profits, arising out of or related to the use or inability to use the Apps.

10. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Spain. Any dispute arising out of these Terms shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain.

11. Changes to the Terms

We may revise these Terms at any time. Changes will be effective once posted. Continued use of the Apps after such changes implies acceptance of the new Terms. We recommend reviewing this page periodically.
